These Terms of Service ("Terms") are a legal agreement between you (and, if applicable, the business you represent, "you" or "Customer") and Trend Watchers, LLC ("Trend Watchers," "Company," "we," "us," or "our"), governing your access to and use of CashCowCRM and related websites, applications, and services (collectively, the "Service").
By creating an account, starting a free trial, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are agreeing on behalf of a business, you represent that you have authority to bind that business, and "you" refers to that business.
You must be at least 18 years old and able to form a binding contract to use the Service. You're responsible for the accuracy of the information you provide when creating an account, for keeping your login credentials confidential, and for all activity that happens under your account. Notify us immediately if you suspect unauthorized use of your account.
CashCowCRM provides pipeline management, contact management, calendar and job scheduling, inventory management, intake and sales tools, approval workflows, executive reporting, and related AI-assisted automation, as made available to your account from time to time. We may add, change, or remove features, and may modify or discontinue the Service (or any part of it), with or without notice, though we'll try to give reasonable notice of material changes that affect paying customers.
We may offer a free trial period (currently 30 days) for new accounts. At the end of the trial, continued use of the Service requires a paid subscription at the pricing and billing frequency shown at signup or checkout. Unless stated otherwise:
You can cancel your subscription at any time; cancellation takes effect at the end of your current billing period unless otherwise stated at signup. See our Refund Policy for how refunds and credits are handled.
As between you and us, you own the contacts, deals, inventory records, calendar data, and other business content you upload or create in CashCowCRM ("Customer Data"). You grant us a license to host, copy, transmit, and process Customer Data solely as necessary to provide, secure, and improve the Service. You're responsible for the accuracy and legality of the Customer Data you upload, and for having the rights needed to share any third-party personal data (such as your own customers' or leads' information) with us. The Service may let you connect third-party tools (such as email, calendar, advertising, or payment platforms). Your use of those integrations is subject to the third party's own terms and privacy policy. We aren't responsible for third-party services, and we don't control how they handle data you choose to share with them.
We (and our licensors) own all right, title, and interest in and to the Service, including its software, design, and trademarks, excluding Customer Data. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes during your subscription.
CashCowCRM includes AI-assisted features that may summarize records, flag deals, suggest scheduling changes, or automate certain actions based on your data. These features are provided as a productivity aid; they may make mistakes, and you're responsible for reviewing and confirming any action that matters before relying on it (such as pricing, contracts, refunds, or communications sent to customers).
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREND WATCHERS, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold Trend Watchers, LLC harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your Customer Data, your violation of these Terms, or your violation of any law or third-party right.
These Terms remain in effect while you use the Service. You may cancel your account at any time as described in Section 3. We may suspend or terminate your access if you materially breach these Terms and don't cure the breach within a reasonable period after notice, or immediately in cases of serious misuse, non-payment, or legal risk. Upon termination, your right to use the Service ends; we'll provide a reasonable opportunity to export your Customer Data unless prohibited by law or the nature of the termination.
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. If we make material changes, we'll provide reasonable notice, such as by posting the updated Terms on this page and updating the effective date, or by emailing the address on your account. Continued use of the Service after changes take effect means you accept the updated Terms.
